Just as a reminder, the Supreme Court will be hearing oral argument today in the habeas case of Gonzalez v. Thaler and the front-end case of Perry v. New Hampshire.
The issues in Gonzalez are: (1) was the order granting a COA sufficient; and (2) for the one-year statute of limitations, what date is used to determine the end of review in state court.
The issue in Perry is: does a non-police-arranged unduly suggestive identification procedure require suppression of an in-court identification?
