Just completed a global update to the Pending Second Circuit Cases page.
Two notes. I was a little surprised to see the State appealing the habeas grant in Somerville v. Conway. I would be truly shocked to see them win that one on appeal.
As I mentioned the other day, petitioner has yet to file a notice of appeal in Seda v. Conway, the case in which the MJ granted a COA on the basis of the pending cert. petition in Battles that challenges the persistent felony offender statute. Still a couple days left, so I hope that comes in.
