I missed a summary order from late last week. It's weird. I checked the summary orders several times that day and I am positive I did not see it. And this is not the first time that's happened. I have no idea why that can happen.
Bonner v. Ercole, 09-4320-pr
- Affirming Denial of Habeas (available here)
- Argued: 10/18/10
- Panel: Calabresi, Livingston, Crotty, DJ
- Lower Ct. Info: 07-CV-399, 2009 WL 3246744 (NDNY Oct. 06, 2009) (JKS)
- In Circuit: Circuit Ct. COA
- Issues: prosecutorial fraud and breach of the plea agreement
QUICK ANALYSIS: Not much to say about it, it's a brief order with very little analysis. The only thing worth noting about the case is that this is the second time that the court has seen this case. It had previously denied habeas using a Musladin analysis that started my whole the troubling trend that is Musladin obsession.
