There is one other interesting angle about yesterday's amazing opinion from the Second Circuit in Friedman v. Rehal that I didn't quite realize.
The Friedman case took place in Nassau County. At the time of the case, there was a different DA in the county. The current DA is Kathleen Rice, who is running for New York State Attorney General. Some places describe her as the "front-runner" for the position.
So the Second Circuit has kind of dropped a political hot potato in her lap right before the September 7 primary. Not a really big one, but a pretty hot one.
A spokesperson from Rice's office provided the following statement: "We are reviewing the decision and will be giving the court's opinion serious thought and consideration."
Pretty bland and diplomatic. I guess she could have been defiant and rushed to support the actions of her predecessor. But, as a political gesture, this seems like the right thing to say.
