Today at 10:00 a.m., the Supreme Court will be hearing argument in Lafler v. Cooper and Missouri v. Frye. Once again the issues in the appeals are (essentially):
(1) Whether a defendant can raise an IAC claim based on deficient performance during plea negotiations even though the defendant was convicted after a trial; and (2) What remedy, if any, should be provided for ineffective assistance of counsel during plea bargain negotiations if the defendant was later convicted and sentenced pursuant to constitutionally adequate procedures?
