Just to note, the Second Circuit issued a summary order the other day in a case called McKinnon v. Superintendent. I am just noting it, rather than actually talking about it, because this was the second time that it was issued. It was originally issued on November 19, 2009.
I checked the docket sheet and, for some reason, the mandate was recalled. The docket sheet does not state why. It appears that the summary order has now been reissued to allow petitioner to file a cert. petition. But that's just what I can gather from a letter from the AG's office, part of which is quoted in a docket entry. But since the docket sheet is pre-ECF, I don't have access to any the filings.
Not much else to say about it, I guess.
