SCOTUSblog had a new Relist (and Hold) post based on the order list from Monday.
The most disappointing news is that the Court denied the petition in Rosario.
Otherwise, after a lot of relist action last week, not too much happened this time. The Cavazos case, mentioned in the previous relist post, got relisted again. Based on how SCOTUSblog described the case last time, I'd say there's a pretty good chance we will be seeing a summary reversal in that case.
The only other habeas action (or better put, non-action) is that the Martinez case (also discussed last time) was not relisted again. As it did last time, the blog speculates that the case could be being held pending Maples. Alternatively, the case (as well as Smith v. Bell, which has a similar issue) may be put on for a later conference. However, the blog notes that other petitions with similar issues will be up for consideration at the May 26 conference. Obviously, Smith and Martinez were not put on for that conference. It could be that the Court is holding Martinez and Smith pending their decision on the petitions with the similar issues. If cert. is granted in those cases, they will remain on hold. If cert. is denied, then they will get put on for a conference and the merits of the petitions in Martinez and Smith will be considered. Of course, as always with relists, it is impossible to know exactly what's going on. But it's fun to speculate.
