About six months ago, I mentioned the academic debate over whether or not non-capital habeas should be abolished. There had been an article recommending its abolition with a shift in resources to increasing the quality of representation at trial. At least I think that's what it was. I read it a long time ago. I posted about it here. And then there was a response by three Cornell Law Professors advocating that habeas be kept in place with some tweaks. As you would expect, I enjoyed the article.

I previously thought that it had already been published. Oh well, it's such a relevant debate to the issues that I cover around here that it doesn't hurt to post about it again.
